We make this website available to help people learn about the firm, explore legal topics and contact us. Please read these terms alongside our Privacy Policy.
01 / Access
Using this website
By accessing or using the website, you agree to these terms and to use the site lawfully. If you do not agree, do not use the interactive features. These terms apply to the public pages, articles and guides, consultation enquiry features, and Counsel, our website assistant.
The website is operated by Njeru Nderitu & Co. Advocates in Kenya. Separate written terms will govern any legal engagement or other service the firm agrees to provide.
02 / Ownership
Our materials
Unless a page says otherwise, the original materials on this website are owned by the firm or used under licence. They include our legal articles, guides, commentary, summaries, written explanations, page design, graphics, illustrations, photographs, videos, compilations, and the selection and arrangement of site content. The firm’s name, logo and other brand elements may also be protected by intellectual-property rights.
Rights are reserved. Making a material available online does not place it in the public domain or grant permission to reuse it. Rights in licensed images, typefaces and other third-party material remain with their respective owners.
03 / Reuse
Copying and permitted use
You may browse the site and share a link to a public page for lawful reference. Unless the firm gives prior written permission or applicable law allows the use, you must not reproduce, republish, distribute, adapt, translate, sell, license, publicly display, or otherwise reuse our original materials or a substantial part of them.
This restriction includes systematic scraping or harvesting of articles and guides, copying them into another publication or commercial service, and incorporating them into a dataset or material used to train or develop an automated system. Do not remove copyright notices or present our work as your own.
Nothing in these terms removes rights that cannot be excluded under Kenyan law. The Copyright Act recognises limited exceptions, including fair dealing for purposes such as research, private use, criticism or review, reporting current events, parody, pastiche or caricature, and quotation. Any applicable conditions, including sufficient acknowledgement of the author or source, continue to apply.
For permission to reproduce or adapt material, contact [email protected] and identify the work, the proposed use, where it will appear and the intended audience.
04 / Sources
Third-party and public legal material
Our articles and guides may refer to statutes, regulations, court decisions, public bodies, or other sources. We do not claim ownership of legislation, judicial decisions or third-party marks. The firm’s original commentary and presentation are distinct from the underlying sources.
Material belonging to another person or organisation remains subject to that rights holder’s terms and applicable law. A citation or link is not a licence to reproduce their material. Check the relevant official source before relying on a law or decision.
05 / Information
Articles are not legal advice
Articles, guides, summaries and other website materials are general information only. They are not a legal opinion, a complete statement of the law, or advice about your particular facts. Laws, regulations and court decisions can change, and the right course may depend on details not covered in an article.
Do not rely on a website article to make a legal decision, miss a deadline, or replace advice from a qualified advocate. Contact the firm for advice about your circumstances. Sending an enquiry or reading content does not, by itself, make you a client or create an advocate-client relationship.
06 / Website assistant
Counsel: general information, not representation
Counsel is an automated website assistant designed to provide general information, point you to firm resources and help you find a route to contact the firm. It is not an advocate, does not represent you, and does not provide legal advice or determine whether the firm will accept a matter.
Responses may be incomplete, inaccurate, out of date or unsuitable for your situation. The assistant may misunderstand a question or omit an important fact. Verify legal information against current official sources and speak with a qualified Kenyan advocate before acting. Do not rely on Counsel for deadlines, urgent matters, court appearances, emergency assistance or decisions affecting your rights.
Do not submit confidential case documents, passwords, full identity numbers, financial account details or sensitive personal information in the chat. A message to Counsel does not establish an advocate-client relationship or assure legal professional confidentiality. For information about handling chat messages, see our Privacy Policy.
07 / Your messages
Messages you send us
You remain responsible for material you submit through Counsel or a consultation enquiry. You must have the right to provide it and must not submit anything unlawful or infringing. You retain any rights you hold in your message. You allow the firm to receive and use it as reasonably necessary to respond to you, operate the requested feature, and protect the service, subject to the Privacy Policy and applicable law.
Do not use the website to send unsolicited advertising, malicious code, threats, or another person’s confidential information without authority.
08 / Responsible use
Acceptable use
Use the site only for lawful purposes. You must not disrupt its operation, attempt unauthorised access to restricted areas, bypass security measures, interfere with another person’s use, or use automated tools to overload or systematically extract site content.
We may limit or suspend access to a feature where reasonably necessary to protect the site, its users or the firm, or to address misuse. This does not affect rights or remedies available under law.
09 / Service
Availability and external links
We aim to keep the website useful and available, but do not guarantee uninterrupted access, error-free content or the continued availability of any particular feature. We may update, change or withdraw pages or features.
The site may link to external websites for convenience or reference. Those sites are controlled by others; we do not endorse or take responsibility for their content, security, availability or privacy practices. You use them under their own terms.
To the extent permitted by law, the website and its materials are provided without a guarantee that they will meet every individual need. Nothing in these terms excludes a right or liability that cannot lawfully be excluded or limited.
10 / Updates
Changes, governing law and contact
We may revise these terms when the website or its features change. The current version and effective date will be shown on this page. Continued use after an update means you are using the site under the revised terms, subject to applicable law.
These terms are governed by the laws of Kenya. Any dispute is subject to the jurisdiction of the competent Kenyan courts, without limiting any mandatory rights or protections that apply to you.
